These Terms of Service ("Terms") govern your access to and use of the PromptForge website and digital products (the "Service"), operated by Damik LLC ("we", "us", "our"), a California limited liability company with its registered address at 1713 Herman Court, Stockton, CA 95206, United States.

1. Acceptance of Terms

By accessing or purchasing from the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service or make a purchase.

3. Digital Products and License

All products sold (prompts, custom GPTs, prompt libraries, courses, templates, and related digital assets) are licensed, not sold. We grant you a non-exclusive, non-transferable, worldwide license to use the products for personal or internal business purposes. You may not:

  • Resell, redistribute, sublicense, or share the products publicly;
  • Claim authorship of the products;
  • Use the products to train competing AI models or to build a competing prompt marketplace.

4. Done-For-You Services

Custom service engagements are governed by a separate scope of work agreed in writing. Timelines, deliverables, and revisions are defined per engagement.

5. Payments

All prices are listed in EUR (€) and are processed by third-party payment providers. You represent that you are authorized to use the payment method submitted.

6. Refunds

See our Refund Policy. Due to the digital nature of the products, refunds are limited.

7. Intellectual Property

All content on the Service, including text, graphics, logos, and code, is the property of Damik LLC or its licensors and is protected by United States and international copyright laws.

8. Disclaimer of Warranties

The Service and products are provided "as is" without warranties of any kind, express or implied. We do not guarantee any specific results from using the products.

9. Limitation of Liability

To the maximum extent permitted by law, Damik LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access at any time for any violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in San Joaquin County, California.

12. Changes

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance.
